Others are allured by the gorgeous, glinting, gold-sand beaches that string around Costa Adeje in the south. Then you get the partiers and the cocktail drinkers, who infuse Los Cristianos with all-night karaoke and dancing. Back from the coast is the more hidden hinterland of Tenerife. That’s fast becoming an adventure mecca. Spiked by the highest mountain in Spain – monstrous Pico del Teide – it’s a rugged land of mossy laurel forests, magma-carved plateaus and whitewashed Canarian villages. And that’s not even mentioning the black-sand bays and surf beaches further north.

If you’re joining the crowds of holidaymakers in this loveable corner of Spain this year, you might want to consider heading for an Airbnb instead of a conventional hotel. Is Airbnb legal in Tenerife?

There’s been an ongoing battle regarding the legality of Airbnb in Tenerife for some years now. Local authorities have attempted to pass legislation that would totally outlaw short-term lets on the island. But there’s also been pushback from owners and certain sectors of the tourist industry. The result has been a tightening of the licensing procedures and stronger checks on properties, effectively cutting the number of listings available via Airbnb.

Although fines and repercussions for not being properly registered are all the responsibility of the host, not the traveler (that’s you), it might be a good idea to check that everything’s in order before you book. You can do that using the contact host feature on any individual property page.

Where should I stay in Tenerife Airbnb?

The 2,000 square kilometres of Tenerife hosts some wonderful spots. Sun seekers are likely to be familiar with the uber-popular beaches in the south, where perennial resorts like Los Cristianos (1) and Costa Adeje (2) make their home. Up north, meanwhile, the buzzing capital of Santa Cruz (3) de Tenerife has markets and museums and more. El Medáno (4) has made its name as a watersports hub on the east coast. Then you have the rustic, remote and beautiful mountain villages of Garachico (5) and Taganana (6) – perfect for seeing Tenerife’s more authentic side.

Lux villas with private pools will usually cost the most, while simple rooms for rent in shared lodgings can be super-easy on the travel budget. Generally speaking, these sorts of lettings will set you back a little less than classic resort hotels. That’s not just down to the nightly rate, though. It’s also because they tend to be in more remote locations on the island, but also often have multiple rooms that let you share the price of a stay with all the other people in your group.

Of course, if you’re keen to be pampered and looked after from check-in to departure, it’s probably better to stick to hotels. Somewhere like the Jardin Tropical Hotel is a prime example. Is renting an apartment profitable in Spain: apartment rental tax and tourist license

Trends in the real estate market

There are three legal ways to rent a house in the Sunny Kingdom:

  • long-term – under the new law of 2019, the contract with the tenant is concluded for at least five years

  • for a short period – from thirty days to eleven months

  • for days and weeks with a special tourist license – in Spain it is requested at the mayor’s office.

A few years ago, in many regions (almost the entire coast of Catalonia), the issuance of such a permit was completely suspended in order to stop speculation in the market and protect the tranquility of local residents – few of the neighbors like the noise and constant parties of foreigners until the morning. Until recently, this rental option was one of the most profitable, until the coronavirus nullified any opportunity to travel. As a result, many hosts who once easily made big money through Booking and Airbnb are now ready to rent out apartments in Spain under a regular contract for a long period.

Apartments for non-tourist rentals in the era of the pandemic continue to be the most in demand in large metropolitan areas, where students, highly qualified specialists, and cultural intelligentsia flock. The most expensive cities in the Kingdom are still Barcelona and Madrid. Housing prices there are not affordable for everyone, so young people prefer to rent apartments together with a few friends. There was even a new niche for realtors – the selection of not an apartment, but a separate room for long-term residence.

The lockdown and the massive shift of companies to remote work has led to another interesting trend – an increase in demand for houses in landscaped suburban areas with their own garden or terrace and good natural light. Economical, but cramped and dark one-room apartments are losing popularity. People are willing to pay extra for a thoughtful layout, more meters and additional infrastructure in the public area of ​​the complex.

Old new law and decree on the regulation of prices in Catalonia

The current rules for renting apartments in Spain are spelled out in a decree of March 2019. It cancels the key provisions of the 2013 reform, which were aimed at stimulating the rental market, and returns to the previous postulates that primarily protect the interests of tenants, not owners.

From now on, the minimum term of a long-term housing contract is again not three, but five years (if the owner is an individual) or as much as seven years (if the owner is a legal entity). In addition, the security deposit (fianza) can no longer exceed two months’ rent, and the procedure for evicting unscrupulous tenants has only become more complicated.

In Catalonia, the rights of owners were also hit by a new amendment of September 22, 2020: now landlords of the most densely populated or touristy cities in the region cannot freely set the price, but must calculate it according to the official index (Indice de la Agencia de la Vivienda de Cataluna). The result directly depends on the footage, location, number of rooms, year of construction of the facility, but insultingly does not take into account a number of important factors: recently made repairs, decoration, specific interior details. For deviation from the recommended cost, a fine of 3000 to

euros. Many owners complain that the calculation formula is confusing, often unfairly devaluing quality properties to rent in Spain and depriving them of any incentive to do so.

Housing for long-term rent

Under current law, the contract is for a minimum of five years. The owner will be able to return the apartment to his use ahead of time only by proving that he urgently needs it for his own living.

Keep in mind that the process of eviction of unscrupulous tenants and occupiers is far from fast in the Kingdom. The presumption of innocence applies specifically to the person directly occupying the disputed living space. If the owner, who lives outside his apartment, brings charges, it is he who must take all the trouble to prove it in court and pay the necessary costs in the proceedings.

In other words, a seasonal rental type. The contract is drawn up for a period of one to eleven months.

Now more and more owners prefer this type of contract with the possibility of extension – this way they have the opportunity to look at the tenant and find a replacement much faster and ask him to move out in case of conflicts.

Obtaining a tourist license

It is not allowed to advertise a listing on portals such as booking and airbnb without providing a special permit number. It should be requested at the city hall, having previously collected the required package of documents.

First of all, you will need to provide a certificate of residence status (cedula de habitabilidad). Also, apartments must be furnished, have a kitchen equipped with appliances, thermal and sound insulation, an emergency telephone list and an evacuation plan on the front door. If the apartment is located above the third floor, the building must have an elevator.

Additional criteria depend on the category your apartment or house is applying for (standard, superior and deluxe).

The license will indicate the maximum number of guests allowed. Management authorities can come with a check at any time. In case of violations, fines and withdrawal of permission are threatened.

Since 2018, in many Spanish cities, the issuance of such licenses has been completely suspended due to the dissatisfaction of the neighbors. It is planned to resume it under new conditions – only in the case of petitions from the owners of not individual apartments, but entire buildings.

What to look for when signing a tenant contract

First of all, you need to check the solvency of the applicant: request his passport data, information on income, employment contract. If a person does not work, you can ask him to pay for housing immediately for several months in advance or require additional information about sponsors. At the slightest doubt, we advise you to consult a lawyer.

At the very beginning of negotiations, you should also ask about the candidate’s marital status and find out if he has pets, if this is important for you. The nuances regarding furniture, the cost of maintaining the apartment, the possibility of terminating the contract without penalties, it is important to carefully discuss in advance and clearly spell out.

Renting an apartment in Spain – what taxes and expenses to pay attention to

Any homeowner in the Kingdom pays:

  • IBI, Impuesto de Bienes Inmuebles (annual property tax calculated on the basis of the cadastral value)

  • Gastos de comunidad (contributions to the community of owners in the case of an apartment building or urbanization): depends on the number of services in your public area. This includes the cleaning of the entrance, the maintenance of the elevator, the pool, the services of a porter or gardener.

  • Insurance (seguro de hogar): on average, 500 euros per year.

There is no separate rental tax in Spain, but your income from rent must be indicated when submitting annual income declarations. When calculating, the key is the ratio of rent to the price at which the owner acquired his property.

Let’s say we bought a one-room apartment of 50 m2 in a five-story building in El Clot, a peripheral area of ​​Barcelona, ​​for 200,000 €. According to the official index, you can rent an apartment with similar characteristics for about 700 € per month. In this case, our income for the year will be 8400 €, and the gross profitability (84000/200000 x 100%) will be 4.2%.

To calculate the net profit, subtract our main expenses from the annual profit (annual IBI tax, utility bills, insurance and emergency amounts for the repair and maintenance of large household appliances, etc.), For a small apartment in a building without an elevator with a small number of tenants, they will not exceed 2000 €. In total, the net profit will be 6400 € with a profit margin of only 3.2%.

When it comes to renting a villa, the calculation formula is the same, with the only difference that you, as the owner, do not have to pay gastos de la comunidad. Is it profitable to rent an apartment in Spain

Now, in almost all major European cities (Rome, Paris, Berlin), the trend is reversed: tighter market controls and laws seeking to guarantee protection and access to housing for the general population, thereby nullifying the attractiveness of this business as a whole.

In Barcelona, ​​these are the Raval and Born quarters, where students and young professionals who are not yet burdened with families are always happy to settle.

  2. It is also worth investing in the purchase of more modern and high-status real estate in a quiet and respectable quarter of a metropolis or a prestigious suburban area. An important role will be played by good daylight, the presence of a spacious terrace and parking, pleasant interiors. In this way, you will attract a completely different class of tenants – middle-aged couples with wealth, not yet able to buy their own housing of this level, but willing to pay good money for rent. Once upon a time, Minskers Mikhail and Antonina decided to invest their money in buying a two-room apartment on the island. Today they tell what it cost them.

Instead of a house in Spain, an apartment in Tenerife

Mikhail and Antonina lived in rented apartments. Small businesses were opened: successful ones were sold, failed ones were closed. When there were already 60,000 euros in the account, the couple thought about buying an apartment for renting out.

The choice fell on real estate abroad: I wanted a place where there is no seasonality, so that demand is year-round. We considered only Europe, with Asia due to strong cultural differences, so far we decided not to get involved. So the guys settled in Tenerife, where you can rent an apartment all year round.

Mikhail understood that the resort would always appeal to vacationers. We collected a package of documents, talked to agents and flew for three weeks to look at options. – Parents said: “Are you so far away! Look at something closer, another country – other customs. But we listened only to ourselves. We studied the issue, found an agency on the Internet. It was scary because we didn’t know anything, but we took the risk, our interlocutors say.

Real estate can be occupied

In three weeks, Belarusians looked at 20 apartments, talked to five agencies and chose one of them. Mikhail explains that buying on your own is dangerous.

— The agency checks the whole story, Escritura (130-page special document signed by the royal house), — the young man says. – Agents protect you from fake heirs. They know the market, suggest where to buy real estate so that it is not occupied. There are entire complexes here where living space is sold for a penny, but invaders come, and nothing can be done with them – they just live in an apartment. They cannot be evicted without a trial.

When buying an apartment, it is important to consider the area. There is Las Americas – it’s “sex, drugs, rock and roll.” After such repairs, on average, they do it once a year: young people come there to have a good rest . And there is our area – these are older people, families, crime here is almost zero. People come to our district to relax culturally, like at home.

Specialists helped the family get a NIE – a tax account number, without which it is impossible to buy real estate, rent a car, connect Wi-Fi. All this is included in the agency’s services, for which it receives 5% of the property value, and the seller pays.

Mikhail says that he had to pay a lot for documents, transfers – they just don’t take cash in Spain.

– As a result, we took out a mortgage. 60% of the cost of the apartment was given to us by the bank, 40% – our savings. That is, for the 60 thousand euros that we had, we flew to the island twice, rested, bought and invested in real estate.

It is not necessary to know the language to buy an apartment: any large agency will have someone who speaks English and even Russian. And if there is no such person in the state, then they will invite.

You can even make money on a mortgage

The house in which the family bought an apartment, built in 1989. After the purchase, the residents of Minsk made cosmetic repairs: they renovated the walls, painted the ceilings, changed the curtains. Initially, the building was a hotel: in Spain this is not uncommon, many residential complexes begin their lives this way.

Before buying, Mikhail and Antonina were interested in specific factors: the view from the window, proximity to the beach, shops, cafes, the presence of a swimming pool in the complex, a terrace, all those services that a tourist needs.

— In financial literacy, there are such concepts as payback and useful lending. Author Robert Kiyosaki promotes this model, and we successfully adopted it, , says Mikhail. – The point is that you take something on credit, and it pays off with your profitability from this and becomes your asset. The main thing is that the purchase covers the costs.

Having done the calculations, the couple took out a mortgage for 25 years and now pays 230 euros on the loan every month. It takes 90 euros to pay bills and “communal”. There is also a real estate tax, which, according to the cadastral value, is 200 euros per year for foreigners. In total, on average, about 400 euros come out per month.

– Therefore, seasonality was not considered: you earn in the summer, and in the winter you pay from what you have earned. This mortgage model does not work.

An apartment brings about 15% of profit per year. This means that in 6-7 years the investment will fully pay off.

You can rent an apartment for a long time, but it is not profitable. If it is taken on a mortgage, it will bring only 6% of the annual income, explains the young man.

“We understood that the agents were fooling us, but they couldn’t do anything”

After the renovation, Mikhail listed the apartment on Airbnb and found agents who agreed to cooperate for a percentage. The couple left for Belarus with a calm soul, but it turned out that the agents were deceiving them: from an accidentally dumped file with black accounting, it became clear that instead of the prescribed 15% they were taking 40%. So they had to work until the next arrival: the family’s financial reserves were depleted, and money there was no flight.

In May, Mikhail and Antonina flew to Tenerife again, having previously booked their own accommodation. So the agents got caught: the family was sent one bill, and on Airbnb it was different.

– After that, we called them to talk. The agents handed over the keys and did not contact us anymore, , the source says. – As a result, it turned out that they did not fulfill much under the contract: our apartment provided disgusting service, bad cleaning was done, no help was provided. During these eight months, we lost about 2,000 euros. Agencies often fool people here, clients live abroad and cannot do anything.

After this service, the couple found other agents with whom they have been working for several years. For a fixed fee of 50 euros, they help to move in, solve technical and domestic issues, and provide a certain range of services. Another 45 euros goes to pay the cleaning lady.

Mikhail explains that it is better to work without agents and supervise everything through Airbnb or Booking. The first often acts on the side of the host, the second – the guest. And although Booking finds more customers, it often fines. Therefore, the family does not use this service.

“Friends from Russia bought four apartments. Three rent out, live in one”

To rent out housing in Tenerife, you do not need to have a residence permit. A person with any citizenship has the right to do this, if such activity does not contradict the laws of his country. But if your housing costs more than 500 thousand euros, then you are considered an investor and you are given a kind of golden card with which you can enter and leave without a visa.

Residents of Minsk took into account the occupancy rate when buying housing. In their area, it is high – about 80%, and with a good repair it will be even higher.

The situation with the coronavirus has also greatly affected this business – it is not working yet. Nobody lives in the apartment now. But Mikhail had long planned to make cosmetic repairs there, which he talks about on his Instagram.

– This is a good time, as the resort is not working yet. You can do everything by the season. I don’t plan to raise the price, I’m even thinking of lowering it a little: the competition will be strong, , the interlocutor says. – We have acquaintances from Russia who bought four apartments: three are rented out, they live in one. Now they are in a clear disadvantage, they do not work. There are many such situations here. But in general, this is a good tactic, I would like that too. If I had two apartments, they would be enough for a comfortable life here. With one, it would be possible to earn 600-1000 euros net per month.

– Most of our guests are from Europe. Europeans love Tenerife. We have regular customers – the Germans, they left on March 17 on the last plane. They are 70 years old, but these are not our old people, these are active people. They figured out how to book a hotel through Airbnb, they come on the same dates, although pensioners, it would seem, should not be tied to dates. They treat housing as if they were their own: they invited us to visit, talked with us if something went wrong. Recently, the key broke, so the man himself found where to fix it. The chair broke — he ordered a new one, went to pick it up 30 kilometers away. Treat everything with care. Next March we are also counting on this couple, – the Minsker shares.

Now you can buy an apartment in a good area for 100-150 thousand euros. They will bring in about 1000-1500 euros per month before taxes. Perhaps after the quarantine the price will drop.

– Now the market has not fallen, real estate has not fallen in price. Rents have dropped slightly: what used to be rented for a thousand euros is now offered for 700. I have many acquaintances who want to buy real estate, and it would seem that now is a convenient time due to falling prices. But no, it’s normal. As for the global fall in prices, it can only be caused by a crisis in which there is no money to pay the mortgage. But there will be no fall – the Spanish government has imposed a moratorium on mortgage payments, management company services and even electricity and water bills, only Wi-Fi can be turned off.

Tenerife is reliable. Judge for yourself – quarantine will end, where will people go? Where they planned, I think. In Barcelona , in the summer of 2017, the city of Barcelona fined Airbnb a record 600,000 euros for illegally advertising tourist accommodation because the owners of the rental property did not have the proper licenses. Airbnb soon removed more than 2,500 listings for tourist accommodation in Barcelona from the site.

In March 2018, the tax authorities decided to take control of the activity of individuals in the rental of real estate through online platforms throughout Spain. Since July of this year, the Ministry of Finance of the country has obliged all Internet platforms for renting accommodation for tourists, such as Airbnb, HomeAway, Wimdu or Niumba, to provide information about the owners of rental housing and tenants to the Tax Agency. This must be done by all persons and organizations that provide intermediary services between landlords and tenants. The reports must indicate the cadastral number of the property, the number of days during which it was rented out to tourists, and the amount received for the specified period.

On May 7, 2018, the Valencia Regional Government amended the new tourism law, which prohibits the rental of all apartments to tourists, except those located on the first and second floors of apartment buildings. Also, the owners of any buildings in which residential premises are used exclusively for renting out will now require a special license, similar to those that hotels receive to conduct their business.

All owners of tourist accommodation, without exception, must register their premises in a special regional register. After such registration, housing receives a unique individual number, which must be indicated in ads on the Internet, including on the sites of international online aggregators. The fine for violation for any aggregator sites can reach 600 thousand euros.

In Madrid , according to local law, the owners of apartments at a general meeting can simply prohibit any rental of housing in an apartment building. The authorities of the Spanish capital are currently considering a law obliging owners of accommodation that is rented to tourists for more than 90 days during the year to acquire a special license.

Prohibited renting apartments in apartment buildings and in the capital of the island of Mallorca – Palma de Mallorca . There, the number of tax-evading landlords using online aggregators like Airbnb has reached 20,000. The city authorities generally banned renting apartments to tourists in the summer season, starting from July 1, 2018. Tourists will be able to rent only private houses located in the tourist area. Owners of houses located in protected areas, in rural areas, in close proximity to airports and in industrial areas will also not be able to offer them to vacationers.

The government of the Balearic Islands, which includes Mallorca, previously fined Airbnb 300,000 euros for listing unlicensed apartments that evade taxes.

On the island of Ibiza , a tough new law has come into force, limiting the ability for tourists to rent private accommodation there through Airbnb and other online platforms from the summer of 2018. In all past years, the island, starting from May, turned into hell for the locals, as hundreds of thousands of tourists came here from all European countries. Residents rented out their homes to them, huddled in vans and even in cardboard boxes on the streets. The municipality decided to put an end to this and introduced a ban on renting housing. But not all areas of the island have yet approved this innovation – you can rent apartments and villas in some parts of Ibiza.

The authorities of the Canary Islands , where renting apartments in apartment buildings was banned back in 2012, also announced the introduction of new additional restrictions on renting housing to tourists through global online aggregators. The islands of Tenerife and Gran Canaria have announced a ban on Airbnb hosting for the summer. The purpose of the ban is to protect the right of local residents to affordable housing, the prices of which have skyrocketed as a result of widespread short-term rentals. An exception from all the Canary Islands is made only for the islands of Palma, Gomera and Hierro, reports The Sun.
