Investors in Palm Beach Club take matters into their own hands –

Palm Beach Club is an iconic holiday resort right on the beach front in Playa de Las Americas, Tenerife. The building was completed in 1983 and until 2014 it was run as a full timeshare resort with RCI exchange systems. Since 2016 it has been possible to book a stay in the resort via various booking agents webpage’s. The resort operators had wanted to restructure the whole building from timeshare into freehold apartments in 2014, but were unable to do so. The plan was then to leave part of the building as a timeshare club, and to convert the rest into apartments.
However, rather than wait to finish the conversion and sell off the apartments, Silverpoint Vacations SL sold companies that in turn owned 52 timeshare weeks. Silverpoint promised that the title deeds would be delivered within 3 years. Investors typically paid from €145,000 for a studio apartment, to €350,000 plus for the penthouses. They definitely would not have paid these sums if they knew they would be left effectively owning 52 weeks of timeshare managed by the resort.
And so, investors in Palm Beach Club have been trapped. It looks unlikely that they will receive a title deed to an apartment anytime soon. Silverpoint, the company that initially sold the investment, is now in liquidation. It then seemed that Excel Hotels and Resorts SA, a related company, would deliver on the promises made by Silverpoint to finish the process of converting the weeks into apartments. However, Excel is now washing their hands of the matter and claiming that it is not their responsibility.
The problem has been compounded by the fact that many companies have as their “administrador único” (sole director), Excel Hotels & Resorts SA – the same company that manages the touristic exploitation of the resort. This is a clear conflict of interest. In fact, since the beginning of 2019 Excel has not paid any money into the bank accounts of many of the investment companies. Yet, in 2019 Excel generated a good income from Palm Beach Club – that year was an excellent one for the resort, with an occupancy rate in excess of 90%.

What can investors in Palm Beach Club do?
Investors have little chance of selling on this kind of investment and so have two options.
The first option is to go to court to seek compensation and have the original purchase declared null and void. The payment of the compensation depends on the outcome of the Silverpoint liquidation, which will be a long process. In a complicated liquidation like this, especially with delays caused by the pandemic, it will be some years before creditors are paid out. The court is investigating pursuing various former owners, directors and advisors for funds, following the company’s collapse.
The second option is to retain ownership of the investment company, but remove Excel from the management. This route allows the investors to retain ownership of the weeks/apartments that they paid so much for in the first place.
A sizable group of investors are now being represented by Tenerife-based consultancy The Nordic Consulting. Ali Farhoud, CEO, explains that “whilst representing owners at the Annual General Meetings of their companies, we discovered that most companies own 52 weeks in one single apartment each. This was great news. We also discovered that these apartments have been generating a healthy income for Excel, but Excel hasn´t passed this on to the companies. That´s when we started to investigate taking control of the companies.”
Mr Farhoud explains that once Excel knew that they were being replaced as sole director of the companies, in some cases, they quickly signed a 10-year agreement between the company and themselves. However, he is confident that this contract can be cancelled through the courts.
“It has been hard work and has taken a lot of time, but we are making progress. We have created a new company – Riekki Opal Management SL – with the necessary legal and accounting resources to run the companies in Palm Beach Club. Now we manage 28 companies and hope that more investors will join the project.”
The objective is for owners to be able to use the weeks in the apartments they own, to sell them if they want, and also to investigate obtaining a license to rent the units out.

Timeshares in Spain: real life stories. Spain in Russian
“The whole world is at your feet, kind-hearted clients. We have a great offer for you: you give us money, and we give you promises!” – something like this should sometimes sound like the slogan of timeshare companies, ruthlessly “undressing” gullible citizens. Timeshare is a special form of property ownership within a club resort hotel on a contractual basis, which gives the right to use the apartment annually for a certain period of time according to the contract (usually weeks).
Timeshare: empty shell in beautiful wrapping
Nevertheless, companies selling such “happiness” do not talk about pitfalls – it is in their interests to find a buyer and sell the maximum set, so agents go to any tricks just to lure them into their networks. For example, when a family arrives at a hotel on the island, a specially trained person is always “attached” to them, who is always close to potential customers. In the process of this communication, the “victims” are constantly in some kind of euphoria from the agent’s colorful stories about the advantages of this island and relaxing there. If the agent sees that there are adult children in the family, then another type of “processing” begins – talk about official employment and further living in this heavenly place on our planet.
“Forgotten” weeks in contracts, apartments for two instead of the promised four, lack of feedback after signing the contract – this is all the reality that comes the moment you become a client.
So the fairy tales that you were told during the “candy-bouquet” period very rarely coincide with the text of the contract. Our editors tried to find out about the “methods” of these companies: customers who were disappointed with “timeshare happiness” shared their stories.

It didn’t happen to me, but to my parents. They are rather just tourists, little understanding, and I can not establish vigilant control over them.
And it’s not the first time this has happened to them. For a long time there was a case when they tried to drag us into such a case. But then I was with my parents, and we managed to safely get away from it. We were caught in Salou, invited to a presentation, then they took us to inspect the apartment complex offered as part of the timeshare.
Then my parents went on vacation, they were met at the Domodedovo airport by some representative, they talked, he took their contacts. Upon returning to Moscow, my parents were “called” and invited to come to the office by the VDNKh metro station. There they were interviewed again, and in the end they signed a contract for 180 thousand, for 5 weeks of residence for 2-3 years. It was the Club La Costa company.
During the last timeshare trip in Tenerife, another interesting story happened. Once we stopped in a village to have a bite of seafood. A girl met us at the restaurant, she gave advice on dishes and at the same time asked if this was our trip to the island on our own or through a tour. We said that through a timeshare. She further suggested that we consider another proposal if we use this type of service. I said no, no need … But this did not stop her – she asked at least to go to the presentation, because then she would receive a “bonus” for this. As expected, my compassionate parents, of course, found the time and the right moment, took 200 euros with them and went to this “wonderful” event.
There they were told everything in the most vivid colors, and as a result they signed an agreement, more like a certificate without a full-fledged two-way translation into Russian, until 2022 for 8 weeks for 3,000 euros.
They already made the initial payment on the same day at the meeting itself, and then they began to pay the rest. Payments could be made within a year and a half, and trips could only begin after making 60%. By December, everything was already paid. And then it began …
We decided to find a place to rest. But it turned out that it was not so easy to do this: we faced all the “buts” and nuances. Later it turned out that there is a contract under which you make a reservation through the Tenetur website and there is an additional one with a certain Interval club, through which there are also some bonus weeks, but no one really tells how to change them and what to do with them and leaves in every possible way from the answer. As a result, every time we contact them with a question about the possibility of organizing a trip, they send us the full cost of living, and thus the point of owning a timeshare and paying for it is completely lost.
In general, the use of weeks is built very cleverly: the contract specifies four contract weeks, and separately there are certificates for four bonus weeks, and not eight contract weeks, as was agreed upon when signing.
But the bonus can only be used by my parents or me, but again only in the company of my parents. Moreover, both parents are required to go – otherwise the weeks will not be provided. There are also time limits: you can take only one week and no more than once every six months. For the rest, accordingly, you have to pay extra, because the apartments that they offer are designed for the premium class, and mid-level hotels, taking into account the timeshare commission for booking, are cheaper to pay on their own without a timeshare at all. In the variant with Tenerife, it is also very problematic with a flight, since profitable charter flights fly only on Fridays, and check-in to apartments from a timeshare occurs only on Saturdays.
As a result, we now do not use it at all and choose and pay for both flights and accommodation ourselves – this is much more profitable and calmer.

Once, in one of the Russian shopping centers, my parents took part in a lottery, the drawing of which was supposed to take place on another day. On the appointed date, they were invited to a travel company, where the draw was taking place. When it took place, they were given the won camera and offered to purchase a vacation ticket. My parents agreed and took two weeks in Tenerife at the Flamingo club, where we went with the whole family. Since the trip was part of the promotion and at a discount, the main condition was that upon arrival we had to attend a four-hour presentation. Naturally, we visited it – otherwise we would not have received back the deposit of 500 euros, which was taken upon check-in at the hotel. Despite the fact that this deposit was taken as a guarantee for the safety of things in the room, in case of non-attendance of the event, it would be non-refundable.
At the presentation, we were sold a timeshare at a price of almost 25,000 euros under the pretext that I would go to work in Tenerife in this club, I would earn a lot of money and not deny myself anything.
Naturally, when you see that an agent drives a good car and describes his life so well, you involuntarily ask yourself: “How to do this? I want that too!” And then the main part of the “processing” began: “The whole magic is that we are members of the club!”.
It looked very serious: they promised an official contract with the subsequent receipt of a residence permit. For our family, this was the main motivating factor in purchasing a timeshare. When we paid off the contract, we also had to pay an annual management fee for the apartments, the amount of which is not specified in the contract itself. It was the same as on booking.com, these apartments are rented to everyone “from the street”, and this is no less than 800 euros. By the way, the cost is also growing every year. And if for ordinary tourists the same apartments are available at any time, then for us, as members of the club, only on fixed dates in the Flamingo complex.
The “working” hook did not justify itself either: together with eleven other applicants, I came for a two-week internship. Naturally, she was not paid, and now the condition for employment was “successful completion of the internship.”
But such “lucky ones” were in for more surprises – there was no salary, no official contract, no work and residence permits.
Some money could be received only if you sell a timeshare – from this transaction, only a commission was promised to the agent’s pocket and only as clients pay for the contract, and this process can stretch up to a couple of years, or maybe even break loose.
Now we have not paid a membership fee for a couple of years, and according to the terms of the contract, if you do not pay for three years, then the client simply loses all the money previously paid, and the contract is automatically canceled. There are firms that can put up such offers for sale, but, firstly, they immediately put 2-3 thousand per week, and this is already a loss of money, and, secondly, this company first needs to pay for advertising and the entire range of PR -services. And only then, if they sell, the client gets something. But all this also looks like another divorce scheme, because I have never heard of anyone successfully selling their timeshare through such organizations.

Each “happy owner” of a timeshare is unhappy in its own way. True, stories
which I had to listen to during the time the material was being prepared, amazing
way similar to each other. Ten years ago, one of my acquaintances, at that time it was good
paid bank employee, thoughtlessly filled out one questionnaire in some
expensive supermarket. The next day she received a call and was told that she had become
happy owner of a week free vacation in the Canary Islands.
But to get a ticket, you had to come to the presentation of the company – definitely
with a husband or friend. It just so happened that neither a husband nor a close friend of my friend
at that time it was not. And she said she was ready to come with a friend. “Come
then with the husband of a friend, ”they insisted on the other end of the wire. The friend thought
that human rights activists do not yet know about timeshare presentations, otherwise they would have raised
noise about discrimination against sexual minorities. But still came to the presentation.

Where is the free cheese
At the presentation, guests were told for a long time about the benefits of timeshare holidays –
saving tens of thousands of dollars for the right to relax in luxury apartments,
as a bonus – a free week of rest, exemption from membership fees
to the club for 2-3 years, the ability to transfer apartments as your own property
by inheritance. It’s hard to say why people buy into these stories. After all, if
you have money, you can travel around the world, live in hotels and apartments
any category, build a daily routine and diet at your own discretion.
Most likely, people fall for advertising due to the lack of complete information, almost
hypnotizing abilities of timeshare sellers, and most importantly – because of the desire to become
the owner of a property somewhere in the Canary Islands.

The happiness of owning a week of holiday in July in a one bedroom apartment in Spanish

Tenerife, and, for example, in Lanzarote. Timeshare advertising promises holidays around the world,
including on exotic islands, in the countries of Latin America, North and
East Africa. My friend hasn’t traveled that far yet. But the seasonal exchange of apartments
in Spain on similar terms in the US cost her $780. Note: in such
the amount I spent renting an apartment in Miami for two weeks (albeit at a low
season). The same amount included an air ticket New York – Miami – New York.
To these fees are added annual membership fees to the timeshare association RCI
– GBP 180 per annum plus annual apartment maintenance fee,
which has grown from 500 pounds to 589. You ask, what does the pounds sterling have to do with it?
The fact is that RCI is registered on the Isle of Man, so payment is made
in British currency. Moscow telephone company 258- .. .. also, it turns out, is located
in Ireland. So timeshare owners communicate only with Irish representatives.
For those it is very convenient to switch off in conflict situations, referring to imperfection
long distance communication.
When a friend once again went to rest in Spain, she could not pay
There is an annual fee for the upkeep of the apartments. Local RCI representatives are always
found an excuse not to get money from her: there is no ribbon in the cash register,
the machine itself is broken. It turned out that this was all for nothing. She was soon informed that she
never paid for her apartment. Therefore, she is deprived of membership in the Golden Club,
for which I have already paid 20 thousand dollars. To regain membership, I had to
pay another 1,000 euros.
So, two weeks of rest at a strictly fixed time with moving from one apartment

When the “happy owners” realized that the annual weekly trip in April for
The Canaries are costing them more and more, they decided to get rid of the apartments.
But it was not there! They were offered to buy a couple more by one week, assuring that
it is impossible to sell what they have. Flatly refusing new purchases,
they demanded back their main contribution – 17 thousand dollars. They were told that
only 2400 can be returned, and even then not immediately. To the surprise of the managers, the couple agreed.
Realizing that the customers were determined, the managers lowered the price to $1,000.
It was just a robbery. The couple decided that they would give their timeshare to adult children.
Now they are waiting for what difficulties and requisitions they still have to face.
“Legal issues were not resolved”
I asked for a comment on the CEO’s timeshare situation.

Legal issues, unfortunately, were not resolved from the very beginning. What is law
ownership of apartments rented for a week or two? This very wording
absurd. More like a myth, although you can use the apartments for life
and you can also pass this week by inheritance. There is no timeshare law in Russia,
but there is a law “On Club Recreation”. Licensing was carried out in accordance with it
timeshare companies. Previously, they were dealt with in the Ministry of Economic Development, where the department
management and tourism. Last year, a reorganization took place – the Federal
tourism agency. Prior to this, club recreation and tourism was handled by the Ministry
physical culture and sports.
Of course, there are customers who are satisfied with all the conditions of the timeshare – there is a lot
depends on the right choice of club. If someone is unlucky from the start,
as your acquaintances, they can file a complaint with the Association of Russian
club companies. It’s in the Solyanka area. We, in turn, will contact
European Timeshare Association, but unfortunately if your representative
company is located abroad, then to resolve all issues you will have to travel abroad
border. For our man it is always difficult…
The conclusion is disappointing. If club rest is only now entering the civilized
channel, then those who were drawn into circulation ten years ago, as happened with my
acquaintances, should treat losses caused by timeshare as losses caused by
default or natural disaster. In our country, no one is responsible for anything.
P.S. Our lawyers doubted the existence of the law “On Club Recreation”. Reference
The legal system “Consultant” gave the answer: there is no law “On Club Recreation”. Was

Pros and cons of a club holiday
Or what is TIMESHARE
My first acquaintance with this concept began back in 1995. Then we (my husband and I) fell for their first inviting action. I must say that during these years almost all my acquaintances came across an aggressive marketing company selling the so-called Timeshare . Bottom line – we bought a week-long study trip to the island of Tenerife for commensurate money and that’s it. You know, we really enjoyed the trip. First, it was our first trip abroad. Secondly, this is Tenerife – a wonderfully beautiful island with comfortable warm weather all year round, whoever has been will probably agree. Thirdly, there were a lot of suckers like us, we became friends and had a great rest. When we returned, we had only pleasant memories, our new friends were less fortunate. They invested money in Timeshare, and when they went to pay the next installment, the seller company was gone, the company disappeared. They could not return the money.
You won’t believe it, but 3 years have passed and we again went on an introductory tour in Tenerife, although now we were already smarter and knew what kind of “beast” it was – Timeshare. ..))) Probably we are incorrigible…. This time we have signed definitively and concluded an agreement directly with the club. From that moment began our love for independent travel. For more than 12 years we have been traveling around countries and continents in search of new sensations and discoveries! And we try to make it as profitable as possible.
Now let’s talk about the circuit itself.
You buy in installments for a week in a certain club, in my case it is a club on the island of Tenerife. (I will give the figures of my specific case, they could change a little)
Types of apartments:
studios – this is an apartment with a combined bedroom and kitchen for 4 people 4x
2-bedroom apartment – three rooms (2 bedrooms and living room with kitchen) for 6x
3-bedroom apartments – respectively for 8x
1-bedroom apartments cost $11,500 under the contract, you can pay in installments for a year ~ $500 per month.
studio – $9,200
Additional payments: A management fee of $400 is paid each year for maintenance of the club (repairs).
+ if you want to visit others besides your club, there are more than 1500 of them all over the world, then also membership in the RSI system (what it is, I will explain later) 50-60$ per year

Every year you can visit your club in your week for free! Ha-ha, you have already invested so much, but nevertheless, we just buy a plane ticket, apply for a visa (if necessary) and go. The idea is this: you buy luxury apartments in a beautiful resort and own them from one to the 51st week of the year. The owners get the right to exchange these weeks of rest for others in any part of the world. And all this for mere pennies compared to the value of real estate in the same resort. Just a few thousand dollars for lifetime, inheritable ownership of the apartment. In addition, you can sell, exchange, lease, bequeath, etc. at any time. If the owner of the timeshare does not wish, he may not rest annually in the same place. The owners of the hotels organized an exchange of holidays for their clients. In Europe, the RCI company is better known, which involves about three thousand clubs in more than 85 countries around the world. A quality vacation, even in the best club, can get boring over time, in order to prevent this from happening, and a system of club week exchange was created. A special commission checks the compliance of the club with certain standards. In addition to owning a club week, you must also have a personal membership in the club.

An important factor is the total area of the apartment and the time spent in the week. Residents of stable countries plan their holidays for years and therefore have the opportunity to increase the exchange rate of their weeks. Unburdened by the problems of visas and flights, they have the opportunity to make late exchanges, in which, having not the best week, they receive in return a better one, which someone refused at the last moment.

There is another very important aspect when buying a club by Russian citizens – the combination of the flight schedule of Russian aircraft with the time of arrival at the club. In Spain, a trial is underway over a group operating in the field of so-called timeshares (shared residential property for recreation) in the Canary Islands – on the island of Tenerife. We are talking about the accomplices of the international swindler John Palmer, who is considered, among other things, the “godfather” of Russian timeshare scammers. Since the 90s of the last century, thousands of Russians have become victims of the latter.
10 people appeared before the court. They are accused of fraud and belonging to a criminal community. The prosecutor demands for the defendants from 8 to 12 years in prison, depending on the degree of guilt, and a fine of 2 million euros. The leader of the gang – John Palmer – is not in court. In recent years, he lived in the UK, and in the summer of 2015, at the age of 64, he was shot dead by a killer in the garden of his own house. However, Palmer’s name is constantly heard at court hearings – the accused are trying to prove that they were intimidated by the leader and were only blind executors of his will. Palmer really was the biggest crime boss. His personal fortune exceeded 600 million euros. Widespread fame, and at the same time the nickname “Goldfinger”, apparently in honor of the negative hero of the third film about James Bond, Palmer received back in 1983, when with a group of intruders he stole three tons of gold from a vault near London Heathrow Airport. The Englishman managed to avoid a prison term for this act. True, at first he was arrested, but then the judges did not have enough evidence of his guilt. In 1985, Palmer settled in the Canary Islands to work in timeshare and beyond. Canarian journalist Ernesto Cobos , who followed his activities, says that John Palmer had about 15 enterprises, but officially he was mainly engaged in timeshare – he owned several buildings in which he sold apartments to foreigners.
– He had a private jet, a helicopter and a yacht at his disposal, says Ernesto Cobos. – The Madrid newspaper “Mundo” wrote at the time that Palmer also dealt in drugs, weapons and was engaged in money laundering offshore. At home in England, he had problems with justice. He was even put in jail in 2001. However, legally, “Goldfinger”, in addition to timeshare, was also engaged in the security business. According to the Spanish press, which refers to the country’s special services, Palmer’s security business was headed by a retired KGB colonel, and Russian “brothers” specially brought to the Canary Islands acted as employees. – They demanded money from people to pay some taxes invented by scammers, notary fees and other payments. The main task was to take as much from the client as possible. The sums demanded from them by fraud sometimes grew up to 50 thousand euros.
Maria Pérez refers to the so-called “shared property” located in seaside resorts. The timeshare system appeared in Spain in the 70s of the last century. It was originally intended for middle class people. Its essence lies in the fact that the same apartment of a residential complex is sold to different persons so that they use it for a certain number of days a year. If, for example, a three-room apartment worth 120,000 euros is sold to 26 clients who want to rest in it for two weeks, then about 4,600 euros should be received from each client of the timeshare administration. Palmer redesigned this system. The owners of similar apartments in his household became not 26, but 260 or even more clients who paid not 4, but 12 thousand euros. The British also developed techniques for luring people into timeshares. They were successfully used in Russia, and before that in Great Britain, Germany and some other European countries.

Antonio Rincón , a journalist who writes about Palmer’s timeshare, says that recruiters chose people by their appearance right on the street or at the entrance to large stores. They offered to answer the questions of a supposedly sociological survey, tried to get a phone number, and a week later they called and invited to some kind of anniversary presentation, assuring that you were lucky that you were chosen from 100 applicants. Well, at the presentation for several hours they were convinced of the expediency of becoming a co-owner of the supposedly prestigious property.
– They convinced you for five hours in a row, showing you photos and real estate plans. And they did it to the music to make you relax. Then you were taken to the office. They poured champagne, congratulated, as if you had won a million in the lottery. Then they asked you to sign documents, assuring that you are making an excellent purchase, and even on the cheap, since right now the prices have been temporarily reduced. They offered to pay in installments, claiming that you could always resell your property, and probably for a higher price. And a lot of people fell for it. Indeed, why not try? And as a result, you bought an imposed timeshare and then could not do anything with it, – says Antonio Rincon.
But Palmer wasn’t content with overpricing or the number of customers who owned only minutes in his timeshare instead of weeks. Another source of enrichment for Goldfinger was the money that was collected from clients as annual fees, for example, for the use of a wellness center on the territory of a timeshare, as taxes for repairs, cleaning, security, electricity, water, paperwork, and so on. Alberto Sanchez , a lawyer representing the interests of Western Europeans who fell victim to a timeshare scam, told Radio Liberty about visiting one of the enterprises, until recently managed by Palmer’s accomplices:
– On the territory of the timeshare there was a thalassotherapy center, a cafe, a restaurant, a massage room – grace . .. but only on paper. In fact, all the buildings and the street on which they were located presented a miserable picture – everything was shabby, dilapidated. The wellness center was permanently closed. Meanwhile, all owners paid at least 300 euros per year to maintain the timeshare. It turned out more than two million. Where did this money go?
With a huge number of customers, Palmer’s enterprises could not provide recreation for the owners of the divided property, especially in the summer – during the holiday season, although they were verbally guaranteed this vacation when they bought it. But, of course, clients were never told that these guarantees, like the rights to the purchased housing, are not at all protected by Spanish law. And they didn’t seem to buy property according to the documents, but only became members of some international club with the right to rest in a club apartment. Lawyer Miguel Fuentes , real estate specialist, explains that the acquisition of one property by many people is not legal at all in Spain. That’s why the term “timeshare” is never used in official documents, he says.

Palmer and his Russian partners made extensive use of this disenfranchisement of their clients. Tenerife administration official Juan Alvarez confirms that the businesses of Palmer and his partners often went bankrupt by their own owners and closed. Temporary people worked in them, and, as a rule, figureheads led them. They were paid only to temporarily cover the real owners of the fraudulent business. Lawyer Alberto Sanchez also hopes that the court will allow the return of the funds of at least some of the clients deceived by Palmer’s group.
– Thousands of people are victims of timeshare scams. I represent the association of the deceived. It covers representatives of different countries of Western Europe. We try to help everyone. Many of the scam victims have already been able to get their money back. Others are trying to do it with the help of lawyers and our association.
In 2008, the European Parliament, in response to the increasing incidence of timeshare fraud, issued a directive obliging EU member states to tighten the relevant legislation. Since then, in the same Spain, criminal cases have been periodically initiated against one or another timeshare company. “After all, Goldfinger’s fraudulent schemes did not die with their author – they continue to be used by other lovers of quick money,” said Alberto Sanchez.
